PRODUCT TERMS OF USE FOR DISIVO AI

INTRODUCTION

This document sets out the terms of use (“AI Terms”) for the AI chat interface feature (“Disivo AI”) within the DISIVO platform, operated by Disivo s.r.o., registered office Smetanova 1022/19, 602 00 Brno, Czech Republic, Czech ID No. 08849048, registered in the Commercial Register maintained by the Regional Court in Brno under C 115814 (“Disivo” or “Provider”). These AI Terms supplement and expand the Terms of Use for Disivo available at https://www.disivo.com/terms/ (“Terms and Conditions”).

These AI Terms apply to each Customer (as defined in the Terms and Conditions) whose users use Disivo AI (“AI Customer”) and to each individual using Disivo AI (“User”). By enabling the use of Disivo AI for its Users, the AI Customer agrees to these AI Terms and is responsible for ensuring each User’s compliance. Any individual who activates or uses Disivo AI represents and warrants that they are authorized to accept these AI Terms on behalf of the AI Customer.

Operation of Disivo AI and Limited Use

1. Disivo AI allows Users to input queries and commands for purposes such as searching, analysis, and other related tasks. Queries are processed using technologies from third-party providers, including Google Gemini, Anthropic Claude, and OpenAI GPT (collectively, “AI Providers”). The content of your queries may be transmitted to these AI Providers for processing and response generation..
2. The AI Customer must ensure that each User uses Disivo AI only in accordance with these AI Terms, Terms and Conditions, applicable laws, and within the scope of the rights granted to them.
3. The User is prohibited from submitting, uploading, or otherwise providing any content through Disivo AI that:
   1. is unlawful, misleading, offensive, or infringes upon the rights of third parties;
   2. would violate confidentiality obligations or disclose trade secrets.
   3. The User must ensure that all content submitted via Disivo AI does not compromise the security, functionality, or stability of Disivo AI.

Liability

1. Disivo AI generates responses automatically, based on machine learning algorithms and artificial intelligence models.
2. Disivo does not guarantee the completeness, accuracy, timeliness, or suitability of responses for the user’s specific purposes.
3. Outputs from Disivo AI may contain errors or inaccuracies. Neither the AI Customer nor the User should rely on such outputs as the sole basis for decisions that may have legal, financial, or other serious consequences.
4. Disivo is not liable for any damage, loss, or harm resulting from the unavailability or malfunction of Disivo AI.
5. The User and AI Customer acknowledge that Disivo AI may, for technical, operational, or other reasons, be temporarily unavailable. Disivo shall not be liable for any unavailability or malfunction of Disivo AI, including, but not limited to, any damage, loss, or harm that the User may incur in connection therewith.

Data processing

1. Use of Disivo AI may involve the processing of information that may constitute personal data, trade secrets, or other sensitive information.
2. Such information may be transferred to AI Providers for processing and generating responses.
3. Details of the scope, purpose, and legal bases of data processing are set out in the Privacy Policy available on the website https://www.disivo.com/privacy-policy/.

Termination and Restriction of Access

1. Disivo may, at its sole discretion and without prior notice, suspend or terminate a User’s or AI Customer’s access to Disivo AI, or limit its available functions, if Disivo reasonably suspects a violation of these Terms or applicable laws, or if the User's or AI Customer's actions compromise the security or stability of the platform.

Links to third party websites

1. Disivo AI may in its replies provide links to third party websites. Disivo is not responsible for the functionality or content of such websites. If the User accesses third-party websites, they do so at their own risk.

Final provisions

1. By using Disivo AI, the User confirms that they have read and agree to these Terms.
2. Disivo is not responsible for any technical problems with Disivo AI or its outages.
3. These Terms may be amended by Disivo at any time. The current Terms are always available online at .
4. All legal relationships arising from or in connection with these AI Terms shall be governed by the laws of the Czech Republic, without regard to its conflict of law principles. The courts of Brno, Czech Republic, shall have exclusive jurisdiction to resolve any disputes. Disivo makes no representation that Disivo AI or these AI Terms comply with the laws of other countries.
5. If any provision of these AI Terms is found to be invalid or unenforceable, it will be replaced by a valid and enforceable provision that most closely achieves the original intent. The invalidity or unenforceability of any provision will not affect the validity of the remaining provisions
6. These Terms are effective as of October 1, 2025.
